Georgia law defines ‘homicide’ as death by the hands of another. Homicide itself is NOT a crime. However, malice murder, felony murder, second-degree murder, and vehicular homicide are major felonies in the Official Code of Georgia and carry the possibility of a long prison sentence. Malice murder involves intentionally causing the death of another person with malice aforethought, either express or implied, while felony murder occurs when someone is killed during the commission of a felony, regardless of intent to kill. Second-degree murder applies when a death results from second-degree child cruelty. Vehicular homicide, meanwhile, involves causing the death of another person through the unlawful operation of a motor vehicle. All of these offenses carry severe penalties, including life imprisonment or even the death penalty in some cases.
